Client Session Agreement


The Session Fee includes the photographer’s time and talent as well as an online gallery for viewing your edited images.  Upon booking your session, a $50 non-refundable deposit is due in the form of cash or PayPal within 48 hours in order to reserve your date and time.  The non-refundable deposit will be deducted from your session fee and the remaining balance will be due before your session begins.  A completed Client Session Agreement and  payment of a non-refundable $50 retainer are required at booking in order to reserve your session.  Images will not be posted for viewing/download until final payment is complete. If Agreement & Payment are not received within 48 hours of booking, your session date/time will be free for another to reserve. Due to the nature of digital products/images, the entire Session Fee Retainer are NON-REFUNDABLE.


In the case of cancellation, we will gladly reschedule your session 1 time within a 1 month period if notice of 24 hours is given. If no reasonable notice is given, you do not show up for your session, or you cancel for a second time during the 1 month period, you forfeit your entire session retainer and another will be required to reschedule. If the Photographer is unable to perform to the guidelines of this contract due to a fire or other casualty, act of God, act of terrorism, or other cause beyond control of the parties, or due to a illness of the Photographer, then the session will be rescheduled. Heather Lynn Photography will not be liable for costs in excess of the amount the client has paid. This limitation of liability will also apply in the event that negatives or digital images are lost through camera malfunction, stolen, damaged in processing, lost in the mail or otherwise damaged or lost without fault of Heather Lynn Photography. Please respect the photographer’s time by showing up for your session on time. If you are more than 15 minutes late, the photographer reserves the right to cancel the session and a new session retainer will be required to reschedule.


Images will be available for viewing approximately 1-2 weeks following your session date.  A link to the gallery will be sent to you via an email sent to the client, or through messenger on Facebook, if applicable.  Galleries will be “active” (accessible) for two weeks from the date they are posted.  Orders are due by the end of that two week period.


All purchased digital images include a print release to print the images at any lab of your choosing, however, Heather Lynn Photography cannot guarantee the print quality of the lab you choose. If printed at a consumer lab (such as Wal-Mart, Walgreens, CVS, etc.), photos may not print as originally intended/showcased by the photographer. You will be provided with a list of recommended labs to achieve the best results, or you have the option to order additional prints through your gallery from a professional print lab at an additional cost to you.


Images will be kept on file for 6 months following the date of your session. All images will be deleted after 6 months of the session date. Additional orders may be placed during this time. A $25 fee is required to reinstate the gallery for a 3-day time period.


All images taken at your session are copyrighted by Heather Lynn Photography and are protected by Federal Copyright Law. It is therefore unlawful to reproduce their work in any manner without written permission from Heather Lynn Photography. Reproduction includes, but is not limited to, scanning, downloading, right-clicking, e-mailing, saving to hard-drive, posting on websites or blogs, photocopying, printing screen shots, or printing non-purchased images in any manner. Please respect Heather Lynn Photography’s livelihood and the care and attention paid to each of your images by adhering to copyright laws. Heather Lynn Photography has artistic control over the final look of the client’s images. Scanned or reproduced images are both illegal and a degradation of the original image quality.


Photography is an artistic interpretation of what a photographer sees when taking a photograph. The interpretation includes the subjects, the posing, the location available and the lighting available at the time of the session. There needs to be a level of trust between the photographer and the subject(s) for the end result to be pleasing to the subject and the photographer. If any party or parties in your session are unwilling to be open to posing or expression suggestions, it is best to discuss this with your photographer before the session begins.


Heather Lynn Photography retains the copyright of all original images and reserves the right to use and reproduce them for the purpose of, but not limited to, advertising, website/blog, display, portfolio, or any publication to promote business free of compensation.


It is understood Heather Lynn Photography is the exclusive official photographer retained to perform the photographic services requested on this Agreement. No other cameras or recording devices are allowed during the photo session, including the use of cell phone cameras.


I have read and understand all of the information in this agreement. I agree to the terms of the agreement and this acknowledgement serves as my electronic signature.
